Harris Baking Co.

Plaintiffs, Rafael Lopez, Zoila Hernandez, and Donna Hill,are current and former hourly employees of the Harris Baking Plant, located in Rogers, Arkansas. Plaintiffs allege that they were not paid for the time spent donning and doffing their uniforms and protective equipment, such as hairnets, beard nets, ear plugs, and gloves, and walking to the time clock.  Plaintiffs also allege that Harris Baking  unlawfully deducted Two Dollars and 20 cents ($2.20) each pay period for laundering of their uniforms.

On April 21, 2015, the Court certitied a class defined as follows:

  • All individuals who were, are, or will be employed by Defendant as non-exempt, hourly paid employees at the Harris Baking plant in Rogers, Arkansas, at any time within the three years prior to the filing of this Complaint through the date of the final disposition of this action, and who were, are, or will be required to perform donning activities without compensation or who were, are, or will be charged $2.20 per pay period for laundering of the uniforms.

If you worked for Harris Baking within the last 3 years , you will soon receive a Notice about the lawsuit in the mail.

The case has been resolved

The case has been resolved. Each class member will recieve an amount calculated from Defendant’s records as follows: (a) $200.00; (b) unpaid overtime the class member would have earned if paid for an additional seven minutes per shift; and (c) the amount deducted for laundry expenses. Defendant will also pay costs, expenses, and attorneys’ fees to class counsel.
