OWNED AND OPERATED BY RETZER, L.L.C., RETZER RESOURCES, INC., THE RETZER GROUP, INC., AND MICHAEL L. RETZER.

 Jonathan Love, Sheri McWilliams, Tracy Keen, Jeremy Pope, and Robin Love worked in McDonald’s restaurants owned and operated by Retzer L.L.C., Retzer Resources, Inc., The Retzer Group, Inc., and Michael L. Retzer (or “McDonald’s”). They brought suit against McDonald’s on behalf of themselves and other similarly situated employees. Because McDonald’s deleted hours from their payroll records, forced them work before they clocked in or after they clocked out, required them to attend unpaid training sessions, and automatically deducted thirty minutes per day from their recorded work time for meal breaks even when the employees were required to work through lunch.

What is in This for Me?

Employees are entitled to be paid for all hours worked at a rate not less than the federal minimum wage ($7.25 an hour) and at a rate of at least one and one-half times an employee’s regular rate of pay for all hours worked over (40) forty.  If McDonald’s did not pay its employees as required by federal law, then the employees will be entitled to be paid for all hours worked at the rate not less than $7.25 per hour and for all overtime hours worked at a rate 1.5 times their regular rate of pay.  Moreover, the law allows the court to double these amounts.

Am I Eligible?

To be eligible for this lawsuit you must:

(1)          Currently work or have worked for a McDonald’s franchise in Arkansas or Missouri owned/operated  by Retzer L.L.C., Retzer Resources, Inc., The Retzer Group, Inc., or Michael L. Retzer at any time in the past three years;

(2)          Have been paid hourly; and

(3)          Have had any of the following occur during your employment:

a.    Had hours you worked deleted hours from your payroll records;

b.    Have been required to work before you clock-in or after you clock-out for the day;

c.    Have been required to attend unpaid training sessions or complete training online;

d.    Have had thirty minutes per day automatically deducted from your recorded work time for meal breaks even when you were required to work through lunch;

e.    Otherwise did not receive compensation for all the time you have worked;

f.     Otherwise did not receive at least the federal minimum wage of at least $7.25 for all hours worked; or

g.    Otherwise did not receive at least one and one-half times your regular rate of pay for all hours worked.

This list may not include all stores. If you are unsure of whether or not your McDonald’s is owned and operated by Retzer, the legal name of the McDonald’s franchise for which you work can often be found on your paycheck or pay stub. If you have worked at a McDonald’s franchise in Arkansas or Missouri that you believe to be owned by Retzer, you may qualify for this suit.

What Time Frame Does This Case Cover?

This case covers two or possibly three years.

Do I have to Pay Anything?

You do not have to pay anything to our firm if you join the lawsuit. We are handling this case on a contingency basis. This means we will only be paid if the lawsuit is successful in obtaining relief either through a settlement or a final judgment, and that payment will only come out of that settlement or final judgment.

How Do I Prove I Worked Overtime?

Where the employer does not keep accurate time records, the employee may make a good faith estimate of overtime hours. If you feel that you have an overtime claim, you do not need to have proof of the hours you worked, and a court will accept an estimate of your hours.

How Long Will This Case Take?

The length of lawsuits varies from case to case. This type of lawsuit typically lasts from one to two years, but the actual length may vary.

Anything that leads you to believe that Retzer L.L.C., Retzer Resources, Inc., The Retzer Group, Inc., or Michael L. Retzer knew about off-the-clock, minimum wage, or overtime wage violations.
